A late Friday afternoon restraining order issued by a Sangamon County Circuit Court judge sprung Illinois school districts into action, including local ones, regarding mask policies, as administrators scrambled for legal advice on how to interpret the ruling before school resumes Monday — with some districts ultimately deciding to suspend the state’s mask rules.
The restraining order from Judge Raylene Grischow blocks nearly 170 school districts named in Greenville attorney Thomas DeVore’s lawsuit from enforcing mask requirements and exclusion rules for students and staff as well as vaccination and testing requirements for school staff without a “due process.”
Grischow denied class certification in the lawsuit. The denial of class certification limits the impact of the involved suit to only those individuals listed as plaintiffs or defendants in the lawsuit.
One local school district — Sandwich District 430 — was named in the litigation.
Additionally, the Illinois Attorney General’s Office is seeking an “expedited appeal” of the restraining order from the Fourth District Appellate Court.
What has resulted regionally is local school districts are deciding their own course of action, until the litigation is settled.

While several school districts, such as Peru and Streator Elementary, Mendota, Putnam County, Unit 2 (Serena) and Fieldcrest schools, Hall and La Salle-Peru high schools, among others, have decided to maintain the state’s orders, that didn’t stop other districts from re-examining their policies.
Seneca High School, for example, issued a letter to its parents implementing a plan its school board put into place in June, in which masking was optional in certain situations. Princeton High School, Princeton Elementary and Earlville school districts also are suspending their mask mandates.
Streator High School scheduled an e-learning day Monday to allow time for its board of education to meet 7 p.m. Monday in the school’s auditorium and vote on following the temporary restraining order.
The La Salle-Peru High School Board called an emergency meeting Sunday to re-examine its COVID-19 policy. Since it was not named in the lawsuit, the board decided to keep its protocols in place, which requires students and staff to wear masks. Some residents attending the meeting shouted in disagreement at the board’s decision, calling them cowards and threatening to vote them out during the next election.
The Appellate Court is expected to issue a ruling on or around Feb. 17, the L-P board said.
“We believe the most prudent course of action is to address our mitigation plans when this information is received and interpreted,” Superintendent Steven Wrobleski said.
Ottawa High School Superintendent Michael Cushing issued a statement on the school’s website stating the school will continue to follow the mandates (executive orders) regarding masking, vaccinations, exclusions, and weekly testing.
Woodland Superintendent Ryan McGuckin said “masks remain on” at the South Streator school until more clarity is given by the district’s legal team, noting the issue is “stuck in legal clouds.”
Pritzker said in a statement Friday that removing the masking policies at school districts may lead to more districts having to go remote if there is increased COVID-19 activity. The Illinois Education Association also issued a statement Friday in disagreement with the ruling, saying it calls into question the safety of schools across the state.

MORRISON, Ill. — A new order from Whiteside County Court ruled the smell of cannabis alone does not give police officers the authority to perform a warrantless search of vehicles in Illinois.
The decision comes after an arrest on December 3, 2020 when an Illinois State Trooper stopped a motor vehicle for speeding on Interstate 88 in rural Whiteside County.
According to the Whiteside County Court order, Trooper Wagand stopped a gray Chevy Impala driven by Kayla Cervantes, with the defendant, Vincent Molina, riding as the passenger.
The trooper requested and received identification during when he said he smelled “raw cannabis”, which prompted him to search the vehicle even after Molina showed his medical use card. Molina was arrested for a misdemeanor possession of 2.6 grams of cannabis.
With the outcome being changed nearly one year later, it’s a decision that could have a historic impact on Illinois government and law enforcement.
“I am honored to have been part of such an important decision. This case was much more important than me,” Molina said. “It was about our right to be free from unreasonable searches for legal conduct. I am just grateful to have been a part of protecting that right.”
Molina’s defense lawyers, Attorneys James Mertes and Nichalas Rude, filed a motion to suppress the evidence, saying the cannabis odor could not be used as a basis for police to search vehicles after the recent decriminalization of cannabis.
Associate Judge of the 14th Judicial Circuit, Daniel J. Dalton, ruled that Molina, “…did not indicate any other reason for his suspicions or his search other than the smell of raw cannabis,” and that, “Molina did provide a medical use license to (the trooper) prior to the search of the vehicle.”
“There are a number of wholly innocent reasons a person or the vehicle in which they are in may smell of raw cannabis,” Dalton said.
There is a possibility the State of Illinois chooses to appeal the court’s decision, which Mertes says he will continue to defend Molina’s rights should the issue enter a higher level of the judicial system.
“The decision of whether to appeal today’s (November 22) ruling belongs to the government,” Mertes said. If the state does appeal, we will continue to vigorously defend the constitutional rights of our client at the appellate levels.”

La Salle: It is unlawful to park any vehicle on any public street in the city limits at any time after 24 hours have elapsed following a snowfall of 3 inches or more until the snow and ice on the public street has been plowed from curb to curb. A person may be subject to a $25 fine for violating the parking ordinance.
Marseilles: After a snowfall of 2 or more inches, it is illegal to park on a street marked as a snow route.
Mendota: It is unlawful to park any vehicle on any public street in the city at any time after a snowfall of 2 inches or more has occurred, unless the snow has ceased and has been plowed off or otherwise removed from the street.
Oglesby: It is unlawful to park any vehicle on any public street in the city at any time within 12 hours after a snowfall of two inches or more has occurred or until the snow has been removed, whichever occurs sooner.

Peru: Parking is prohibited on city streets after 3 inches of snowfall. The city of Peru deploys up to 15 trucks to both plow and salt the nearly 70 miles of city streets during and after snowfalls. When the roads are clear of vehicles plow truck drivers can more safely and efficiently clean streets. Vehicles should be moved in advance of the snow event but no later than when 3 inches of snow has fallen and not be parked back on the city streets until such time the street is cleared from curb to curb.
Princeton: It is unlawful for any person to park any vehicle on any public street, alley or municipally owned or leased parking lot in the city at anytime within 12 hours after a snowfall of 3 inches or more has occurred or until the snow has been removed. Vehicles parked in violation of this section may be removed at the owner’s expense.
Seneca: The village of Seneca is asking residents to move their vehicles off of the streets so snowplows can get through. If vehicles are in the way, streets may not get plowed.
Spring Valley: Parking is prohibited on marked snow routes and in the downtown business district after 3 inches of snow.
Streator: A vehicle cannot be parked on Main Street between 3 and 5 a.m., or at any time on Bridge, Bloomington or Park streets within the city limits, when snowfall reaches a depth of two inches or more. A vehicle in violation of this section may be towed from its location.

As far as snowfall forecasts go this event verified nicely as most areas ended up in their projected ranges. La Salle/Peru has been one spot that actually received more than expected and Lincoln slightly less. The anticipated wedge of dry air northeast of I-74 reduced snowfall rates and kept accumulations to under an inch across the eastern half of the region. Meanwhile heavier snow accumulations were seen across Knox, Fulton and McDonough Counties where localized bands of heavier snow allowed for totals to exceed 3 inches.

MOUND CITY, IL — Three men have been charged in connection with a shooting that injured one woman in Mound City, Illinois, earlier this week.
A woman was shot late Tuesday night while she was sitting in the back of a Pulaski County Sheriff’s Office cruiser. The incident happened at a home in the 700 block of Pearl Street. Investigators have said a suspect fired in the direction of a deputy, but instead hit the woman.

Friday, the Illinois State Police announced three Mound City men — 24-year-old Kendall L.D. Mcelmurry, 26-year-old Demarko K. Ransom and 21-year-old Andre L. Mcelmurry — were arrested in connection to the shooting incident, after they were charged Thursday by Pulaski County State’s Attorney Lisa Casper. 
Kendall Mcelmurry is charged with aggravated battery of a peace officer, aggravated assault of a peace officer, obstructing justice and resisting a peace officer.
Ransom is charged with obstructing justice in furtherance of gang activity, obstructing justice, obstructing a peace officer and resisting a peace officer.
Andre Mcelmurry is charged with aggravated battery of a peace officer and aggravated assault of a peace officer.
ISP said bond for both Mcelmurry was set at $100,000 with 10% to apply. Bond for Ransom was set at $50,000, also with 10% to apply. The three men each posted bond and have been released from custody. 
State police say the investigation into the shooting is ongoing, and anyone with information regarding the incident can call ISP Division of Criminal Investigation Zone 7 at 618-542-2171, ext. 1207.

Illinois State Police, Boone County Sheriff’s deputies, LifeLine paramedics and firefighters and paramedics from Boone County Fire Protection District #2 responded about 3:16 a.m. Saturday, October 02, 2021 to a report of a serious crash with entrapment involving a truck and a passenger vehicle on I-90 WEST at Milepost 26.75 in Boone County.

Illinois State Police on arrival discovered a vehicle in the right ditch and a red semitrailer truck on the left shoulder with debris covering all lanes. One person was reported dead at the scene in the vehicle off the right shoulder. A passenger was also injured in that vehicle. The crash involved a black Honda Civic and a red Volvo Truck Tractor. The truck driver was not injured.
All westbound lanes were shut down at Illinois Route 23 and were allowed to re-enter I-90 west at Genoa Road.

Honda Civic driver Adrian Reyes-Marin, a 36-year-old male from Rockford, Illinois was pronounced dead at the scene, according to initial reports. Honda passenger Tracy Aarli, a 40-year-old female from Rockford, Illinois was transported by ambulance to an area hospital with injuries initially believed to be non-life-threatening.
Truck driver Abdishakur Musa, a 31-year-old male from Savage, Michigan did not initially report any injuries. Truck passenger Yussof Musa, a 27-year-old male from Savage, Michigan did not initially report any injuries.
A preliminary investigation indicates that the red Volvo truck tractor was traveling west in the center lane of Interstate 90 WEST near milepost 26.75. The driver of the Honda Civic was also traveling west, behind the truck. For unknown reasons, the driver of the Honda Civic struck the rear of the truck. After the impact, the Honda Civic left the road to the right, struck an embankment and rolled over. The truck also left the road to the right, struck the embankment and a sign pole. The driver of the Honda Civic was transported by ambulance to an area hospital and was pronounced deceased, according to the Illinois State Police. The passenger in the Honda Civic was transported by ambulance to an area hospital with non-life-threatening injuries. The driver and passenger of traveling in the truck reported no injuries. All westbound lanes were closed and traffic was being diverted onto Route 23, according to Illinois State Police.

A secondary crash occurred about 5:49 a.m. at I-90 WEST and Illinois Route 23 when the driver of a vehicle hit a Tollway HELP truck blocking for the primary I-90 crash. The vehicle burst into flames when it hit the tollway maintenance truck. A male victim was still in the vehicle while the vehicle was fully engulfed with fire. The driver crashed into the back of the tollway truck at the offramp from I-90 to Illinois Route 23. While the driver was unable to get out of his vehicle, the vehicle exploded at about 5:52 a.m.

Hampshire firefighters responded to the secondary crash, and reported one victim was pronounced deceased at the scene. The HELP truck driver was standing outside the truck when the crash occurred. The HELP truck driver reported he was not physically injured, but was shaken up.
Initially there were no official details from the Illinois State Police regarding the victim or the victim’s vehicle involved in the secondary crash at I-90 and Illinois Route 23. A Crash Reconstruction Officer (CRO) was called to both the primary crash scene and the secondary crash scene.

PADUCAH — There’s new competition for internet providers in the area — good news for you. And 20 to 25 new jobs by 2022  — good news for the economy.
Quad State Internet is the first internet service provider in Paducah to offer fiber to the home.
That means it uses fiber optic cable to deliver internet connection from a central base location.
Dozens gathered today to celebrate a new internet provider in Paducah.
It started as three separate companies that joined in partnership. 
“So we came together, basically created our own internet, our own system, and then decided why don’t we expand that system to other people,” said Brandon Moss, the director of business development for Quad State Internet.
It’s called Quad State Internet, and the company hopes to change the way people in the area get connected.
Quad State is a local company, so if you were to use its services, it wouldn’t be based out of places like Atlanta, Chicago, or Nashville. 
“Whenever you’re buying Quad State internet, because our internet exchange point is right here, the internet actually starts right here out of Paducah,” said Preston Louis Ursini, the director of network operations with Quad State Internet. “So rather than buying internet that’s 300 miles away, you’re buying it right here.”
Quad State hopes to change IT internet infrastructure in the area too — and “bring it to the modern world.”
Local business leaders say that it’s encouraging for Quad State to make a presence.
“So as we draw more people here and as certainly as we continue to bring more jobs to the community, there will be even an increased demand for internet and fiber connectivity,” said Bruce Wilcox, the president and CEO of Greater Paducah Economic Development. 
And with more people comes a greater need for connecting with others.
Leaders say prices would be around $35 a month for internet.
Quad State is also putting together plans to present to the city about fiber internet in low socioeconomic areas in Paducah. 
The company’s website says it is also available for service in Calloway County, LaCenter, Lone Oak, Grand Rivers, Webster, Morganfield and Calvert City.

LAMOILLE- Two people are dead after a two vehicle crash in Bureau County Saturday.   According to authorities around 7 AM LaMoille Fire and EMS were called to US Route 34 west of the community for the crash that killed both drivers.   The Bureau County Sheriff’s Office stated that a 48-year-old Princeton man and a 66-year-old Sublette man were pronounced dead at the scene.   Their identities are being withheld pending family notification.   The crash remains under investigation by the Illinois State Police, Bureau County Sheriff’s Office and the Bureau County Coroner.
